1. About Deep Align

Deep Align is a personal wellness application for iPhone and iPad that provides daily affirmations, breathing exercises, and mindfulness content. These Terms govern your use of the Deep Align app and any related services or websites operated by us.

"Deep Align," "we," "us," or "our" refers to Vibe2Viable, the developer and operator of the Deep Align application. "You" refers to the individual using the app.

2. Acceptance of Terms

By downloading, installing, or using Deep Align, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you are under 18, you may use Deep Align only with the consent of a parent or guardian who agrees to these Terms on your behalf.

3. Subscriptions and Payment

3.1 Subscription Plans

Deep Align offers a free tier and optional paid subscriptions (monthly and annual) that unlock the full app experience, including the complete affirmation library, all breathing exercises, home screen widgets, and Discover mode.

3.2 Payment Processing

All purchases and subscription payments are processed entirely through the Apple App Store. We do not collect, handle, or store your payment information in any form. Your purchase is subject to Apple's terms and conditions: apple.com/legal/internet-services/itunes/.

3.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You will be charged through your Apple ID account.

To cancel your subscription: open iOS Settings → tap your name → Subscriptions → select Deep Align → Cancel Subscription.

Important: Deleting the Deep Align app from your device does not automatically cancel your subscription. You must cancel through iOS Settings as described above to stop future charges.

3.4 Refunds

All refund requests are handled by Apple in accordance with their App Store refund policy. To request a refund, visit reportaproblem.apple.com. We do not have the ability to issue refunds directly.

3.5 Price Changes

We may change subscription prices from time to time. Apple will notify you before any price change takes effect. If you do not agree with the new price, you may cancel before the next renewal.

4. Use of the App

4.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Deep Align on Apple devices you own or control, for personal, non-commercial purposes, in accordance with these Terms.

4.2 Prohibited Uses

You agree not to:

• Copy, modify, distribute, sell, or sublicense any part of the app or its content
• Reverse engineer, decompile, or disassemble the app
• Use the app for any unlawful or unauthorized purpose
• Remove or alter any copyright, trademark, or proprietary notices
• Attempt to circumvent subscription requirements or access restrictions
• Use automated means to access or interact with the app

4.3 Eligibility

Deep Align is available on the App Store for users in supported regions. You must comply with all applicable laws in your jurisdiction when using the app.

5. Content

5.1 App Content

All affirmations, breathing exercise programs, interface elements, and other content within Deep Align are owned by us and protected by copyright and intellectual property laws. You may not reproduce or redistribute this content without our permission.

5.2 Personal Use Only

The content in Deep Align is licensed to you for personal, non-commercial use only. Purchased subscriptions are for individual use and may not be shared.

5.3 Not Medical or Professional Advice

The affirmations, breathing exercises, and wellness content in Deep Align are provided for personal enrichment and general wellbeing purposes only. They are not a substitute for professional medical, psychological, or mental health advice, diagnosis, or treatment.

If you are experiencing mental health challenges, please consult a qualified healthcare professional. In an emergency, contact emergency services immediately.

6. No User Accounts or Personal Data

Deep Align does not require or create user accounts. We do not collect personal information from you. All app data (preferences, streak history, saved affirmations) is stored locally on your device.

7. Disclaimer of Warranties

DEEP ALIGN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The app will be uninterrupted, error-free, or free from bugs
• The content will produce any particular result for your wellbeing
• The app will be compatible with all devices or operating system versions
• Any defects will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIBE2VIABLE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or app content (e.g., streak loss after device reset)
• Loss of access during service interruptions or app updates
• Any outcomes related to your use of affirmations or wellness content
• Damages arising from reliance on content in the app

Vibe2Viable's total liability to you for any claim arising out of these Terms or your use of Deep Align shall not exceed the amount you paid for your subscription in the twelve (12) months preceding the claim, or $10, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Deep Align and its developers from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the app.

10. Third-Party Services

Deep Align may link to or reference third-party websites or services (such as Apple's App Store). We are not responsible for the content, privacy practices, or terms of any third-party services.

Your use of the App Store is governed by Apple's terms and conditions. Apple is not a party to these Terms and has no obligation to provide support or maintenance for Deep Align.

11. Termination

We reserve the right to discontinue Deep Align or remove it from the App Store at any time, with or without notice. If the app is discontinued, your subscription (if active) will be managed through Apple's standard refund policies.

You may stop using Deep Align at any time by deleting it from your device and cancelling any active subscription through the App Store.

12. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including, without limitation, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics, strikes, shortages of transportation, fuel, energy, labor, or materials, failure of third-party services (including Apple's App Store or cloud infrastructure providers), or interruptions to the internet or telecommunications infrastructure.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be noted in App Store release notes and on this page. The "Last Updated" date at the top of this page reflects when the Terms were most recently revised.

Your continued use of Deep Align after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Deep Align shall be resolved in the state or federal courts located in Virginia.

ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND VIBE2VIABLE AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
